California Requires Sellers to Disclose Thirdhand Smoke in Home Sales

California is the first state in the world to mandate home sellers disclose thirdhand smoke to buyers under Assembly Bill 455, effective Jan. 1. Thirdhand smoke consists of toxic chemicals from cigarettes and vaping that accumulate on surfaces like carpets, walls, furniture, and dust.

The law, signed by Governor Newsom, applies to single-family home sales and aims to protect buyers from long-lasting health risks, including cancer, heart disease, and respiratory issues, particularly for children and the elderly. Sellers who fail to disclose thirdhand smoke may face litigation.

Researchers at San Diego State University, whose work influenced the legislation, note that chemicals such as nicotine, lead, and cadmium can persist for the life of a building. Experts hope the law will eventually expand to other housing types and inspire similar regulations in other states.
